NiceFunnel Terms of Service
- Operator: Oberil LLC, a Wyoming limited liability company, doing business as NiceFunnel ("NiceFunnel", "we", "us"), 30 N Gould St Ste N, Sheridan, WY 82801, USA
- Contact: help@nicefunnel.com
- Effective date and version: October 4, 2026 (version 1.0)
1. What NiceFunnel is
NiceFunnel is software that lets creators ("Sellers") build a public page, sell digital products (downloads, courses, and scheduled sessions), collect contacts, and run simple sales funnels. People who buy from Sellers are "Buyers". Everyone using the service is a "User".
When a Buyer purchases a Seller's product, the Seller is the merchant. The payment is processed on the Seller's own Stripe account. NiceFunnel provides the technology and is not the seller of creators' products, not a merchant of record for them, and does not hold Buyer funds.
2. Who may use NiceFunnel
- You must be at least 18, or the age of majority where you live if that is higher, to create an account or to buy on NiceFunnel.
- Sellers must be based in a country where NiceFunnel supports Stripe onboarding (the list is shown when you connect Stripe) and must pass Stripe's verification. Buyers can be anywhere Stripe accepts payments, subject to sanctions and the law.
- You must give accurate information and keep your login secure. You are responsible for activity on your account.
3. Additional terms
- Sellers also agree to the Seller Agreement.
- Everyone agrees to the Acceptable Use Policy.
- Our Privacy Policy and Cookie Notice explain how data is handled.
- Payments are also subject to Stripe's terms (the Stripe Services Agreement and, for Sellers, the Stripe Connected Account Agreement).
4. Buying from a Seller
- The Seller describes the product, sets the price (including "pay what you want" minimums), and is responsible for delivering it and supporting it. A product is either free or costs at least US$1.99 (or the equivalent minimum shown in the editor).
- Discounts, add-ons, limited quantities, and end dates are set by the Seller and are applied at checkout exactly as shown before you pay.
- Access to a purchase is tied to the account you bought it with.
- Refunds follow the refund policy shown on the product page and at checkout before you pay. Each one-time product shows its refund-request window (none, 7, 14, or 30 days from purchase; 14 days unless the Seller chose otherwise). The window shown when you buy applies to that purchase even if the Seller changes it later. Within the window you can ask for a refund from your purchase page; the Seller approves (in full or in part) or declines with a reason. A Seller may also refund you voluntarily at any time.
- Membership payments: you can ask for a refund of your most recent membership payment within 7 days of that payment. Approving it does not cancel the membership unless the Seller or you cancel it.
- Whatever the stated policy, if a paid product is not delivered, cannot be accessed because of a Seller or platform fault, or is materially different from its description, contact the Seller first and then help@nicefunnel.com if it is not resolved. Nothing here limits rights you have under law or with your card issuer.
- Scheduled sessions are not confirmed until the Seller confirms a time.
5. NiceFunnel subscriptions (for Sellers)
- Plans: Free ($0, NiceFunnel keeps a 5% platform fee per sale), Creator ($29 per month), Growth ($79 per month). Prices in USD plus any taxes shown before payment. No free trials.
- Paid plans renew monthly until canceled in the billing portal. Cancellation takes effect at the end of the paid period.
- First-payment goodwill refund: if you subscribe to a paid plan for the first time, you may ask for a refund of that first monthly charge within 7 calendar days of it by writing to help@nicefunnel.com. An approved refund ends the paid plan. Later renewals are not refunded except where the law requires or we choose to.
- If a paid plan ends, features limited to that plan stop working and the public page may be made private until it fits the Free plan's limits. Your content is kept under the Privacy Policy's retention rules.
- We may change prices with at least 30 days' notice before your next renewal.
6. Your content
- You keep ownership of what you upload (text, images, files, product content).
- You give NiceFunnel a limited license to host, copy, display, and deliver your content only to operate the service (for example, showing your page and delivering files to your Buyers).
- You confirm you have the rights to everything you upload and sell.
- We may remove content that breaks these terms, the Acceptable Use Policy, or the law.
Copyright complaints (DMCA). We respond to notices of alleged copyright infringement under the US Digital Millennium Copyright Act. Send notices to our designated Copyright Agent: Copyright Agent, Oberil LLC (NiceFunnel), 30 N Gould St Ste N, Sheridan, WY 82801, USA, abuse@nicefunnel.com. A notice must include: (1) your physical or electronic signature; (2) identification of the copyrighted work; (3) the URL or other information identifying the material you say infringes; (4) your contact details; (5) a statement that you have a good-faith belief the use is not authorized by the copyright owner, its agent, or the law; and (6) a statement, under penalty of perjury, that the notice is accurate and that you are the owner or authorized to act for the owner. If your content was removed, you may send a counter-notice with the information required by 17 U.S.C. § 512(g)(3); we may restore the content after 10 to 14 business days unless the complainant tells us it has filed a court action. We terminate the accounts of repeat infringers in appropriate circumstances.
7. Acceptable behavior
Do not misuse the service: no illegal, infringing, deceptive, or harmful products or activity; no attempts to break security, scrape, overload, or get around plan limits or payment checks. Full list in the Acceptable Use Policy.
8. Suspension and termination
- You can close your account at any time by writing to help@nicefunnel.com from your account email. We confirm the request, cancel any paid plan at the end of its period, and delete your account and content within 30 days, except records we must keep by law or to handle open orders, refunds, disputes, taxes, fraud, or security (see the Privacy Policy). A Seller who closes their account must first deliver, or refund, anything Buyers have paid for and not yet received.
- We may suspend or close accounts, remove listings, or stop new sales to address violations, fraud, security risks, or legal or payment-provider requirements. Where safe and lawful, we explain why and allow a review request.
- Closing an account does not cancel obligations already owed (for example, delivering what was sold, refunds, disputes, taxes).
9. Availability and changes
- We work to keep NiceFunnel available but do not promise it will be uninterrupted or error-free.
- We may change or remove features. For material changes to these terms we give notice 30 days in advance by email or in the app. Continuing to use NiceFunnel after the change takes effect means you accept the new terms; if you do not, you can close your account.
10. Disclaimers
NiceFunnel is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement, and any warranty that the service will be uninterrupted, secure, or error-free. We do not make or guarantee Sellers' products, claims, or results; those are the Seller's responsibility. Some jurisdictions do not allow certain disclaimers, so some of these may not apply to you, and nothing here excludes warranties or guarantees that cannot be excluded under consumer law.
11. Limitation of liability
To the fullest extent permitted by law:
- NiceFunnel and its members, managers, employees, and suppliers are not liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, or goodwill, arising from or related to NiceFunnel, even if advised of the possibility.
- Our total liability for all claims arising from or related to NiceFunnel is limited to the greater of (a) the fees you paid to NiceFunnel (plan fees and platform fees, not amounts paid to Sellers) in the 12 months before the event giving rise to the claim, and (b) US$100.
- These limits do not apply to liability that cannot be limited by law, including for fraud, gross negligence or willful misconduct, or death or personal injury caused by negligence, and they do not limit mandatory consumer rights where you live.
12. Indemnity
Sellers are responsible for claims arising from their products, content, and dealings with Buyers. To the extent permitted by law, you will defend, indemnify, and hold harmless Oberil LLC and its members, managers, employees, and agents from any third-party claims, losses, liabilities, damages, fines, and reasonable costs (including attorneys' fees) arising from (a) your content, products, or services, (b) your dealings with Buyers, contacts, or other Users, including refunds, disputes, delivery, and taxes, (c) your breach of these terms, the Seller Agreement, or the Acceptable Use Policy, or (d) your violation of law or of anyone's rights. We will notify you of a claim, may participate with counsel of our choice, and you may not settle a claim that imposes obligations on us without our written consent. This section does not apply to consumers acting outside a trade or business where the law does not allow it.
13. Disputes and governing law
- Governing law. These terms are governed by the laws of the State of Wyoming and applicable US federal law, without regard to conflict-of-law rules. If you are a consumer in a country whose law gives you the benefit of its mandatory consumer protections or local courts, nothing here takes those away.
- Talk to us first. Before starting a claim, send a written description of the dispute and what you want to help@nicefunnel.com. Both sides will try in good faith to resolve it informally for 30 days.
- Small claims. Either side may bring an individual claim in a small claims court that has jurisdiction.
- Arbitration. Otherwise, if you are in the United States, any dispute that is not resolved informally will be decided by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules (or Commercial Arbitration Rules for business Users), held remotely or in Wyoming, and judgment on the award may be entered in any court with jurisdiction. Either side may seek injunctive relief in court for intellectual-property misuse or unauthorized access to the service.
- Class-action waiver. To the extent permitted by law, claims may be brought only individually, not as a plaintiff or class member in any class, collective, or representative proceeding, and the arbitrator may not consolidate claims.
- Opt-out. You may opt out of arbitration within 30 days of first accepting these terms by emailing help@nicefunnel.com with your name, account email, and a clear statement that you opt out.
- Venue. Any dispute not subject to arbitration will be brought in the state or federal courts located in Wyoming, and both sides consent to their jurisdiction, subject to your mandatory consumer rights.
