NiceFunnel Seller Agreement
- Operator: Oberil LLC, a Wyoming limited liability company, doing business as NiceFunnel
- Effective date: October 4, 2026
1. Eligibility
- You are at least 18 (or the age of majority where you live, if higher), based in a country where NiceFunnel supports Stripe onboarding (shown when you connect Stripe), and legally able to run your business.
- You complete Stripe's onboarding for your own connected account and keep it in good standing. No borrowed identities or false countries.
2. You are the merchant
- Buyers purchase from you. Payments are made on your Stripe connected account (Stripe "direct charges"). NiceFunnel does not hold your sales money.
- You are responsible for your products, their descriptions, delivery, customer support, refunds, disputes (chargebacks), and taxes on your sales. Unless and until NiceFunnel tells you in writing that it is acting as a marketplace facilitator in a particular state or country, you are responsible for determining, collecting, reporting, and paying any sales tax, VAT, GST, or similar tax on your sales.
- Refunds and chargebacks come out of your Stripe balance. If your balance is not enough, Stripe may recover the amount from future sales or your bank account under your agreement with Stripe; NiceFunnel does not pay refunds or chargebacks on your behalf.
3. Plans and fees
| Plan | Price | NiceFunnel fee per sale | Products |
|---|---|---|---|
| Free | $0 | 5% of each sale, collected as a Stripe application fee | up to 3 |
| Creator | $29 per month | 0% | up to 10 |
| Growth | $79 per month | 0% | up to 50 |
- Stripe's own processing fees are separate, are charged by Stripe directly to your connected account, and are shown in your Stripe account. Stripe does not return its processing fee when you refund a payment.
- On the Free plan, if you refund a sale, NiceFunnel returns the matching share of its 5% fee (a full refund returns the full fee). If you lose a dispute, the fee is returned in full.
- Paid plans are billed monthly in advance, renew until canceled, and have no free trial.
- Prices: each product is either free or priced at least US$1.99 (or the minimum shown in the editor).
- Refund windows: for each one-time product you choose whether Buyers may request a refund and for how long (none, 7, 14, or 30 days; 14 by default). The window shown at purchase is fixed for that purchase. You review each request and approve (in full or in part) or decline with a reason that is emailed to the Buyer. Members may request a refund of their latest membership payment within 7 days of it. You may also refund voluntarily at any time.
- Plan features: Creator adds lead magnets, discount codes, analytics, and limited quantity and end dates. Growth adds order bumps, after-purchase offers, email to contacts, and branding removal. Features are only active while the plan is active.
4. Payouts
Payouts are made by Stripe to the bank account on your connected account, on Stripe's schedule. NiceFunnel cannot speed up, hold, or redirect your payouts except through mechanisms Stripe provides and the law allows.
5. Selling honestly
- Describe what buyers get accurately, including format, access length, and anything required to use it.
- Real scarcity only. Limited quantities and end dates must be real. Do not reset a countdown, recreate a "sold out" product to restart it, or claim limits that do not exist. Compare-at ("was") prices must be prices you genuinely offered.
- Pay what you want: the minimum you set is a real price; do not mislead buyers about where their money goes.
- No fake testimonials, reviews, or earnings claims.
- Follow NiceFunnel's minimum buyer protections and the refund policy shown before purchase.
6. Contacts and email marketing
- Only email people who opted in on your page or who agreed to receive updates. NiceFunnel does not currently offer importing contact lists; if it does in future, you may import only people who gave you permission to email them, and never bought, scraped, or borrowed lists.
- Every newsletter NiceFunnel sends includes your mailing address and a one-click unsubscribe; you must provide a real postal address and not ask people to do more than unsubscribe.
- Do not use misleading subject lines or sender names. You are responsible for complying with CAN-SPAM and any other law that applies to your recipients (for example GDPR consent rules for people in the EU).
- NiceFunnel enforces sending limits (currently 3 emails and 20 tests per day, 10,000 emails per month on Growth) and may pause sending if bounces or complaints are high.
7. Content and rights
You own your content and confirm you have every right needed to sell it. You follow the Acceptable Use Policy.
8. Data you receive
You receive your Buyers' and contacts' emails and names to fulfill orders and send updates they asked for. Use them only for that, keep them secure, and honor deletion and unsubscribe requests. For this data you are the controller and NiceFunnel processes it on your behalf as described in the Privacy Policy. If the law that applies to you requires a Data Processing Addendum (for example GDPR or UK GDPR), request one from privacy@nicefunnel.com and it forms part of this agreement.
If you add your own analytics or advertising pixels (Google Analytics 4, Meta Pixel, TikTok Pixel, Microsoft Clarity), you are responsible for that provider's use of visitor data, for your own privacy notice, and for complying with the provider's terms. NiceFunnel loads them only after the visitor accepts the cookie prompt on your pages.
9. Suspension
NiceFunnel may stop new sales, remove listings, or suspend accounts for violations, fraud, high dispute rates, or legal or Stripe requirements. Your obligations to existing buyers continue.
10. Taxes and reporting
You handle taxes on your sales and on your income, as described in section 2. Because payments are made on your own Stripe account, Stripe is responsible for any payment-processor tax reporting to you and to tax authorities (for example Form 1099-K in the United States or DAC7 reporting in the EU) where the law requires it. You agree to give Stripe and NiceFunnel accurate tax information when asked. NiceFunnel invoices you for its plan fees and platform fees and may add taxes to those fees where required.
